ByWater Solutions, LLC respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Discovery Platform. Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE PRODUCT.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date to this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Public Policy by your continued use of the App after the date such revised Privacy Policy is posted.
This Privacy Policy does not apply to third-party products that may be connected to Aspen Discovery, including your Public Library, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.
COLLECTION OF YOUR INFORMATION
We may collect information about you in a variety of ways. The information we may collect via Aspen Discovery depends on the content and material you use and includes:
Personal Data
Personal data collected includes demographics and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to use our platform to access your library information.
Derivative Data
The information our servers automatically collect when you use Aspen, such as native actions that are integral to the product, including book search, recommendations, as well as other interactions with Aspen and other users via server log files.
Financial Data
We collect no financial data and will not ask for your financial information. Any payment information submitted through Aspen will be processed using third-party systems not hosted or provided by ByWater.

USE OF YOUR INFORMATION
Having accurate information about you enables us to provide you with a smooth, efficient, and customized experience. Specifically, we may use the information collected about you via Aspen to:

We collect and use the information such as the items listed above, that you provide voluntarily when you register for an Aspen account, or if you correspond with us. We may also retain any messages you send through Aspen and may collect the information you provide in the User Content you post to the interface. We use this information to operate, maintain, and provide you with the features and functionality of Aspen Discovery.
We may receive information about you from third parties. For example, if you access Aspen through a third-party connection or login through your public library, they may share your information with us. This collected information may be used in connection with analytic data to better understand and improve our products and services. All of the data is used to personalize the experience or for authentication purposes.
Stored Information:
When you visit Aspen Discovery, it stores information to help you log in faster and enhance your navigation through the site, by providing a “session token” (session tokens begin when you log in and close when you log out, not when the site is opened/closed). All of the information related to the user is stored until the user logs out. All data relating to the user, which may include Username, Password, first name, last name, email, and the library that you have connected to, is encrypted.
Logfile information
Logfile information is automatically reported by your browser or mobile device each time you access Aspen Discovery. When you use Aspen, our servers automatically record certain log file information. These service logs may include anonymous information such as your requests, Internet Protocol (“IP”) address, and browser type.

While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our best efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against interception or other types of misuse. Any information disclosed online is vulnerable to interception and use by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

ACCOUNT INFORMATION
You may at any time review or change the information in your account or terminate your account by logging into your account settings and updating your account information.
Upon your request to terminate your account, ByWater and your Library will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and/or comply with legal requirements.
SALE OR BANKRUPTCY
If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline to honor commitments we made in this Privacy Policy.
We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails, or other communications from other parties, you are responsible for contacting the third party directly.
CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclose to third parties for direct marketing purposes and the names and address of all third parties with which we share personal information in the immediately preceding calendar year. CANADIAN PRIVACY RIGHTS
CONSENT
If you wish to use Aspen Discovery, all information used is gathered through your library. That said, Aspen Discovery does store some personal information such as name, barcode, and email to make it easier for the user to login.
Individual Access
As a user, you have the right to access any data a company has collected on you. Once your request is made, organizations will have 30 days to respond and provide you with the requested information.
